Each party must comply with its obligations under the discount safe harbor to the Anti-Kickback Statute, 42 C.F.R. 1001.952(h), and any similar federal or state laws on the reporting of provision of information on discounts, rebates, or other reduction in price for items or services covered by government health care programs or other third-party payers. RSVP participants acknowledge that RSVP products are for sleep titration purposes only and shall not be resold or billed to any third-party payer, including Medicare or Medicaid. The Parties certify that they will not violate the federal Anti-Kickback Statute with respect to the performance of this Agreement.
